End User Licence Agreement

This End User Licence Agreement (“Agreement”) is between you (“Licensee”) and Ivan Smetanin, operating as iffun (“Licensor”, “we”), and governs your use of the Boopster software (“Software”). By installing or using the Software you agree to this Agreement.
1. Definitions
“Software” means the Boopster plugin for Adobe Premiere Pro together with the local Boopster engine and any updates. “Licence Key” means the access credential that activates the Software for your account.
2. Licence grant
We grant you a non-exclusive, non-transferable, perpetual licence to install and use the Software on up to three (3) devices you own or control, for your own purposes, including commercial work.
3. Restrictions
You may not: (a) reverse engineer, decompile or disassemble the Software, except to the extent this restriction is prohibited by applicable law; (b) redistribute, resell, rent, sublicense or otherwise transfer the Software or share your Licence Key; (c) remove proprietary notices.
4. Activation and telemetry
The Software activates and periodically verifies your licence online and may send minimal technical telemetry. Your media (video and audio) is processed locally on your device and is never uploaded to us. Data handling is described in our Privacy Policy.
5. Intellectual property
The Software is licensed, not sold. We retain all right, title and interest in the Software. This Agreement grants no rights to our trademarks.
6. Third-party components
The Software incorporates open-source components (including FFmpeg, whisper.cpp, pyannote and OpenCV), used under their respective licences; attributions are provided within the Software or its documentation.
7. Disclaimer of warranties
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENCE, AND WE WILL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
9. Term and termination
This Agreement applies for as long as you use the Software. It terminates automatically if you breach it; on termination you must stop using and remove the Software.
10. Purchase and reseller
Purchases are processed by Dodo Payments as Merchant of Record (the authorised reseller of the Software). The purchase transaction is governed by Dodo’s Buyer Terms; this Agreement governs your use of the Software.
11. Refunds
See our Refund Policy. You acknowledge that the licence is delivered immediately on activation/download; where a statutory right of withdrawal applies, it is lost once delivery has begun, to the extent permitted by law.
12. Governing law
This Agreement is governed by the laws of [governing law — to be set], without prejudice to mandatory consumer-protection rights you have in your country of residence.
